ORDER

The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the respondents to provide electricity service connection to the property comprised in Survey No. 175/1 situated at Puliyamarathu Kottai Village, Oddanchatram Taluk, Dindigul District.

2. The petitioner claims to have purchased the said property through a registered sale deed dated 12.05.2025. The third respondent has objected to the petitioner's request for electricity service connection on the ground that the property had been sold by her husband without the consent of the minor children.

3. It is seen that the petitioner has filed a suit for permanent injunction, in which an order of temporary injunction has been granted. On the other hand, the minor children, represented by the third respondent, have filed a suit for declaration and permanent injunction in O.S. No. 57 of 2025 before the jurisdictional Civil Court. Both suits are pending. It is further noted that the sale deed executed in favour of the petitioner has been duly mutated in the revenue records. In the absence of any order of restraint, the petitioner's application for electricity service connection cannot be rejected solely on the ground that civil suits are pending between the parties.

4. In view of the above, this writ petition is disposed of with a direction to respondents 1 and 2 to provide electricity service connection to the property comprised in Survey No. 175/1 situated at Puliyamarathu Kottai Village, Oddanchatram Taluk, 3/6

5.The above exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petitions are closed.

6. It is made clear that the provision of electricity service connection shall not be construed as recognition of the petitioner's possession or title to the property. It is open to the parties to agitate their respective rights in the pending civil suits before the jurisdictional Civil Court. The Civil Court shall decide the suits on their own merits and in accordance with law, uninfluenced by any observations made in this order or by the grant of electricity service connection.
