O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 28.11.2025 and to conduct a survey of the land and demarcate the boundaries in T.S.Nos.3064, 3065 and 3068, Kaddusekkadi Street, Melapalayam Village, Palayamkottai Taluk, Tirunelveli District, within a time to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the third respondent, as no adverse orders are proposed to be passed against the third respondent.

3. The learned counsel appearing for the petitioner would submit that an online application has been submitted for the survey of the property in question and for demarcation of its boundaries. Page No. 2 of 5

The learned Additional Government Pleader appearing for the first and second respondents, on instructions, would submit that a part of the land is Government land and that however, after considering the claims of the parties, appropriate steps would be taken to survey and demarcate the land in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. According to the learned Additional Government Pleader appearing for the first and second respondents, a portion of the land is Government land. Since an application has been made for survey, it is for the first and second respondents to consider and dispose of the same after taking into account the extent of the Government land. Accordingly, this Court directs the first and second respondents to consider the online application dated 28.11.2025 and after considering the claims of all parties, including the third respondent and the extent of the Government land, survey and demarcate the petitioner's land and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of sixteen (16) weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. It is Page No. 3 of 5

needless to state that prior to surveying the land, notice shall be issued to the adjacent landowners, the third respondent and other interested persons, if any.

6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
