Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India for issuance of Writ of Mandamus, directing the respondent to issue patta in respect of the property of the vacant Plot No.18 measuring to an extent of 170.011 sq.Mtr and Plot No.4 measuring to an extent 161.772 Sq.Mtr and Plot No.16 measuring to an extent of 161.772 Sq.Mtr comprised in Survey Nos.604/2B2 and Survey No.604/3B situated at KalappaKulam Panchayat, Kalappakulam, Sankarankovil Taluk, Tenkasi District upon considering the application of the petitioner dated 04.01.2022 for issuance of Patta within the period that may be stipulated by this Court.

ORDER

This writ petition has been filed seeking for Mandamus to direct the respondent to consider the petitioner's application dated 04.01.2022, seeking for patta in respect of her property being vacant Plot No.18 measuring to an extent of 170.011 sq.Mtr and Plot No.4 measuring to an extent 161.772 Sq.Mtr and Plot No.16 measuring to an extent of 161.772 Sq.Mtr comprised in Survey Nos.604/2B2 and Survey No.604/3B situated at KalappaKulam Panchayat, Kalappakulam, Sankarankovil Taluk, Tenkasi District, within a time frame to be fixed by this Court.

2.The petitioner claims that she is the owner of the aforementioned property. She has submitted the aforementioned application to the respondent seeking for patta. Since the application has not been considered till date, she has filed this writ petition.

W.P(MD).No.2516 of 2022 3.Mrs.S.Jeyapriya, learned Government Advocate, accepts notice on behalf of the respondent and submits that the aforementioned property is a temple land. The said statement is recorded.

4.However, no prejudice will be caused to the respondent, if the petitioner's application dated 04.01.2022, seeking for issuance of patta is considered on merits and in accordance with law. 5.For the foregoing reasons, this Court directs the respondent to consider the petitioner's application dated 04.01.2022, seeking for issuance of patta for the aforementioned property, on merits and in accordance with law, after affording a fair hearing to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the aforesaid directions, this writ petition is disposed of. No costs.
