RESPONDENT/RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition imposed by this Honourable Court on the petitioner in Crl.M.P.(MD) No.7148 of 2021 in Crl.R.C.(MD) No.389 of 2021 dated 12/11/2021.

PRAYER IN Crl.R.C.(MD) No.389 of 2021:

To call for the records pertaining to the judgment dated 20.02.2020 passed in C.A.No.12 of 2018 on the file of the Principal District and Sessions Court, Pudukottai confirming the judgment dated 21.02.2018 in C.C.No.164 of 2010 on the file of the Judicial Magistrate, Aranthangi and set aside the same. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SANKARASUBBU R, Advocate for the petitioner and of M/S.M.AASHA, Government Advocate (Criminal Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.M.P.(MD)No.7148 of 2021 in Crl.R.C.(MD)No.389 of 2021 dated 12.11.2021.

2.The learned counsel for the petitioner submitted that this Court has granted suspension of sentence to the petitioner on 12.11.2021, directing the petitioner to appear before the Mint (H1) Police Station, Old Washermanpet, Chennai at 10.30 a.m., until further orders. He further submitted that the petitioner is complying the condition regularly and prayed the petition to be allowed.

CRL MP(MD) No.2415 of 2022 3.The learned Government Advocate (Crl. side) appearing for the respondent fairly admitted that the petitioner is complying the condition till now.

4.In view of the aforesaid submission, this Court is inclined to modify the condition imposed by this Court in Crl.M.P.(MD)No.7148 of 2021 dated 15.02.2022. Hence, this Criminal Miscellaneous Petition is partly allowed and the condition imposed on the petitioner is modified to the effect that the petitioner is directed to appear before the concerned trial Court once in fifteen days at 10.30 a.m., until further orders.
