Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 4, particularly, the fourth respondent to grant patta in favour of the petitioner for the nanja land property comprised in S.No.552/1 to an extent of 0.54.5 hectare situated at Ilanthaikulam Village, Konthagai Group, Thiruppuvanam Taluk, Sivagangai District, by considering the 1/4

petitioner's representation dated 14.11.2024, within a stipulated time fixed by this Court.

ORDER

The petitioner seeks a direction for issuance of a writ of mandamus to direct the fourth respondent to grant patta in respect of the petitioner's Nanja land comprised in S.No.552/1, measuring 0.54.5 hectares at Ilanthaikulam Village, Konthagai Group, Thiruppuvanam Taluk, Sivagangai District.

2.The petitioner has given a representation on 14.11.2024 in this regard and he seeks the representation to be disposed of within a stipulated time frame.

3.The learned Additional Government Pleader appearing for the official respondents would submit that the subject S.No.552/1 is a 2/4

water body and hence, patta cannot be issued to the petitioner. However, the learned counsel for the petitioner relies on the revenue receipts issued by the Revenue Inspector, Konthagai Village, to support the averments in the affidavit in support of the writ petition that the lands belong to the petitioner.

4.Without going into the merits of the issue of whether the subject lands are Nanja lands capable of being mutated in the name of the petitioner or whether it is a water body as contended by the learned Additional Government Pleader, it is a matter for the fourth respondent to take a decision on merits and dispose of the pending representation of the petitioner within a period of eight weeks from the date of receipt of a copy of this order.

5.With the above directions, this Writ Petition is disposed of. No costs.
