the civil dispute between the petitioner and the 3rd respondent in respect of dwelling house in Plot No.9, Shanthanam Nagar, Ponmeni Jaya Nagar, within the Madurai Corporation Limit, Madurai and the petition in Crl.O.P(MD) No. 2182 of 2020 has been filed to direct the respondents 1 and 2 to secure and produce the body of the detenue namely Prabusankar, son of Late Subbiah, aged 45 years before this Honourable court and set him at liberty.
2. The learned counsel for the petitioner would submit that the petitioner got married to one Prabusankar 18 years back and that on 28.09.2019 one Sundarraj and his henchmen came to the house of the petitioner and told the petitioner to receive Rs.20lakhs and vacate the house. The said Sundarraj had informed her that he had purchased the petitioners house from the third respondent . The petitioner refused to reply. Whileso, the husband of the petitioner was found missing in respect of which the petitioner preferred complaint, whereas the respondent did not register the case. Now on the instigation of her mother-in-law and the said Sundarraj the respondent police is forcing the petitioner to vacate the house. He would further submit that the petitioner has got a minor daughter and she is living alone in the said house and thereby she needs to be give protection.
3. The learned Additional Public Prosecutor would submit that the petitioner's husband was missing. On the complaint given by the third respondent in Crl.O.P(MD) No.2474 of 2020 a case in Crime No.172 of 2020 was registered under the caption 'Man Missing' and the respondent police are taking steps to locate the missing person. The respondent police have summoned the petitioner only to enquire about the whereabouts of her husband whereas the petitioner is not co-operating for enquiry. With regard to the allegations that the fourth respondent is harassing the petitioner to vacate the house, he would submit that the respondent police is not harassing the petitioner to vacate the house.
4. Recording the same, this Criminal Original Petition is closed. Consequently connected miscellaneous petition is also closed.
