Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 1st respondent to reject the patta application made by the respondents 2 and 3 at Eriyodul Village in Vedasanthur Taluk, Dindigul District and provide the report to the petitioner on his representation dated 07.01.2022, in accordance with law within the time stipulated by this Court. O R D E R

*********** This writ petition has been filed seeking for a direction to the first respondent to reject the patta application submitted by the second and third respondents in respect of the property at Eriyodul Village in Vedasanthur Taluk, Dindigul District, based on the petitioner's representation dated 07.01.2022. 2.The prayer sought for in this writ petition cannot be granted by this Court. Admittedly, the application has been submitted by the respondents 2 and 3 seeking patta for the aforementioned property. If at all the petitioner is interested in the very same property and entitled for patta in his name, he can only be heard by the concerned Tahsildar before whom the application has been submitted by the second and third respondents seeking for patta before final orders are passed in the said application.

3.The petitioner cannot seek for rejection of the application filed by the second and third respondents seeking for patta under Article 226 of the Constitution of India. Therefore, this Court directs the concerned Tahsildar before whom the application submitted by the second and third respondents is pending with regard to the issuance of patta for the aforementioned property, to give https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.[MD]No.2537 of 2022 notice to the petitioner as well and also give a fair hearing to the petitioner and the respondents 2 and 3, before passing final order on the application submitted by the second and third respondents seeking for issuance of patta for the aforementioned property. 4.With the aforesaid direction, this Writ Petition is disposed of. No costs.
