ORDER

This Criminal Miscellaneous Petition has been filed to relax the condition No.9(iv) imposed upon Revision Petitioner in Crl.MP(MD)No. 11248 of 2024 in Crl.R.C.(MD)No.1011 of 2024, dated 22.10.2024. Paragraph No.9(iv) reads as under:- "9(iv) The petitioner shall appear before the trial Court once in a month i.e., on the first working day of every English calender month at 10.30 a.m., until further orders and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 of Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court" 2.Heard M/s.M.Benazir, learned counsel for revision petitioner.

3. Learned counsel for revision petitioner would submit that petitioner is 62 years old and he has been taking care of his wife, who is suffering from various ailments such as Rheumatoid Arthritis, Hypothyrodism and etc.

4. He would further submit that petitioner's wife has underwent cataract surgery and cholecystectomy surgery and hence, he is unable to comply with the conditions regularly.

Taking into consideration the submissions made by learned counsel for petitioner, condition No.9(iv) imposed by this Court in Crl.MP(MD)No.11248 of 2024 in Crl.R.C.(MD)No.1011 of 2024, dated 22.10.2024, is modified as follows:- "9(iv). The petitioner shall appear before the trial Court once in two months ie.,on the first working day of every alternate month ie., commencing from March 2026, until further orders."

6.With the aforesaid modification, this Criminal Miscellaneous Petition stands ordered.
