PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to withdraw of the case in Crime No.318 of 2020 pending on the file of the second respondent and entrust the same to the fourth respondent for investigation of the case by a competent officer and file a final report before the Jurisdictional Magistrate within the time stipulated by this Court.

ORDER

This petition has been filed seeking direction to withdraw of the case in Crime No.318 of 2020 pending on the file of the second respondent and entrust the same to the fourth respondent for investigation of the case by a competent officer and file a final report before the Jurisdictional Magistrate within the time stipulated by this Court.

2.The learned Additional Public Prosecutor would submit based on the complaint given by the petitioner the second respondent https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.2726 of 2022 police has registered the First Information Report in Crime No.318 of 2020 for the offences under Sections 294(b), 324,342,355,362 and 506(ii) of IPC and thereafter conducted detailed investigation and they are about to file the final report.

3. At this juncture, if the investigation is transferred to another investigating agency the entire investigation will be affected.

4. In view of the same, the petition stands dismissed. However the second respondent is directed to file the final report before the concerned Court within a period of two weeks from the date of receipt of a copy of this order.
