PRAYER: FOR BAIL IN CRIME NO.136 OF 2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner/A6, who was arrested and remanded to judicial custody on 10.09.2023, for the offences punishable under Sections 8(C), 20(b)(ii)(C), 25 of NDPS 1/3

Act and Section 201 of IPC in Crime No.136 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 200 kg of Ganja. Hence, the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. This is the second bail petition. Earlier petition filed by the petitioner in CrlOP(MD)No.21323 of 2023 was dismissed by this Court on 03.01.2024. Further, he is in judicial custody from 10.09.2023. Hence, he prays for grant of bail to the petitioner. 4.The learned Additional Public Prosecutor for the State would submit that this is the second bail petition. Earlier bail petition was dismissed by this Court, on 03.01.2024. Now, there is no change of circumstances. Thereby, he vehemently opposed to grant bail to the petitioner.

5.Considering the above facts and circumstances of the case and also considering the fact that there is no change of circumstances, this Court is not 2/3

inclined to grant bail to the petitioner.
