The petitioner/complainant in CC No. 325 of 2023, has approached this Court, seeking a direction to the trial Court to proceed 1/4

with the trial and conclude the same within a stipulated time. 2.The learned counsel appearing for the petitioner submits that he has initiated proceedings under Section 138 of Negotiable Instruments Act, 1881 as against the respondent herein and the same was taken cognizance by the learned Judicial Magistrate, Sathankulam in CC No.325 of 2023 on 15.09.2023 and it is still pending. Therefore, he sought for a direction to dispose of the above case at the earliest. 3.This Court, by order dated, 08.02.2024, called for a report from the trial Court. The trial Court has also filed a report stating that sworn statement of the complainant was recorded on 15.09.2023. Since the accused was absent, a bailable warrant was issued on 08.12.2023. The accused was surrendered on 19.01.2024 and therefore, the Bailable warrant issued as against the accused was recalled. The case is posted for the complainant's side evidence on 08.03.2024. 2/4
