PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned Top letter in Na.KA.C4/2/5/2026 dated 08.01.2026 of the 1st respondent herein and quash the same and consequently directing the 1st respondent to take petitioner appeal petition dated 20.12.2025 on his file for disposal.

ORDER

The present writ petition has been filed challenging the order passed by the 1st respondent herein under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, wherein the appeal preferred by the writ petitioner has been rejected on the ground that he is neither a Senior Citizen nor a Parent.

2. A perusal of Section 16 of the above said Act reveals that an appeal can be preferred only by a Senior Citizen or a Parent. However, the petitioner being neither a Senior Citizen nor a Parent, cannot prefer an appeal before the first respondent. Therefore, this Court does not find any illegality or irregularity in the order passed by the first respondent.

3. The writ petition stands disposed of with the liberty to the petitioner to challenge the order of the second respondent, dated 01.12.2025, by way of writ petition, if he is so advised. No costs. Consequently, connected miscellaneous petition is also closed.
