Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The Petitioners apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 352, 406, 407, 420 and 506(i) of the Indian Penal Code in Crime No.217 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2. The Prosecution case is that the accused and the defacto complainant were doing grain business and the accused without maintaining proper accounts have misappropriated a sum of Rs.4,69,000/-.
3. The learned counsel for the petitioners submitted that the petitioners are husband and wife and the defacto complainant is none other than the grandfather of the second petitioner. Due to family dispute, the petitioners were falsely implicated in this case. It is further submitted that the second petitioner is working as a Teacher in the Government Higher Secondary School, Kuruvikulam, Tirunelveli District.
4. Heard the learned Government Advocate (Criminal Side).
5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.
6. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Sankarankovil, Tirunelveli District and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first petitioner https://hcservices.ecourts.gov.in/hcservices/
shall appear before the respondent police daily at 10.00 a.m., until further orders and the second petitioner shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C.Scrupulously.
