O R D E R

The audit objection provided to the writ petitioner by the second respondent is under challenge in the present Writ Petition.

2. The issue in nutshell raised is that an audit objection is imposed without any show cause notice to the writ petitioner. Admittedly, an audit objection was raised in respect of grant of incentive increment for acquiring additional educational qualification. The audit party raised an objection on the ground that the petitioner is not eligible for incentive increment.

3. The audit objection provided to the petitioner cannot constitute a cause of action for the purpose of entertaining the Writ Petition. The information itself shall be taken as a notice to the writ petitioner. On receipt of any such information that the actions are proposed for recovery, then the petitioner is entitled to submit his explanation / objection in respect of the proposed recovery to be made based on the audit objection raised. Thus, the impugned information shall be treated as a notice to the writ petitioner and the writ petitioner is at liberty to submit his explanation / objection along with the documents, orders if any within a period of one week from the date of receipt of a copy of this order. On receipt of any such reply / objection from the petitioner, the Competent Authority / respondents are bound to consider the explanation and take a decision on merits and in accordance with law and pass a speaking order as expeditiously as possible.
