ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari to quash the impugned order passed by the 1st respondent dated 27.06.2023.

2. The petitioner and the third respondent admit the fact that the property originally belonged to one Vembaiyan, who had one son and four daughters. However, a dispute has been raised by the third respondent stating that the said Vembaiyan had executed a Will in favour of Paramasivam, and therefore the other sisters did not have any right over the property. The petitioner claims to have purchased the property from the sisters on the ground that they had a share in the property. Thus, there is a rival claim between the parties.

3. Therefore, this Writ Petition is allowed. The impugned order passed by the 1st respondent in Pa.Mu.No.964/O/2023 dated 27.06.2023 is hereby 2/4

set aside. If there is any rival dispute, the petitioner and the 3rd respondent are at liberty to approach the competent Civil Court to establish their respective rights. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed.
