K.V.Rajendran : Respondent PRAYER: Contempt petitioner filed under Section 11 of Contempt of Courts Act, to punish the contemnor / 1st respondent for the deliberate and wilful disobedience of the common order, dated 24.11.2022 passed by this Court in W.P(MD).No.14700 of 2012.

O R D E R

The learned counsel appearing for the contemnor submitted that the company is under liquidation. Therefore, they are not able to disburse the amount which was granted in the Writ Petition.

2. This Court is of the considered opinion that if any company is under liquidation, the entire affairs of the company should be with the official liquidator alone. The contemnor has produce the details of the official liquidator as under:

"The Official Liquidator, At the provisional Liquidation of the Sri Ganapathy Mills Company Limited (in liquidation), Kuralagam, Block I, First Floor, Esplanade, Chennai -08".

Therefore, the petitioner, who is the wife of the deceased employee, is permitted to approach the official liquidator.

3. With the above said direction, the Contempt Petition is closed. However, liberty is granted to the petitioner to approach this Court, if she 2/4

is aggrieved.
