Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A4 apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A), 406, 506(i) I.P.C and Section 4 of Tamil Nadu Prohibition of Women Harassment Act, 2012 and Section 4 of Dowry Prohibition Act in Crime No.10 of 2014 on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that the de-facto complainant is the wife of A1 and the petitioner/A4 is the maternal uncle of the defacto complainant's husband and all the accused harassed the de-facto complainant by demanding more dowry.

3.It is submitted by the learned counsel for the petitioner that the petitioner is innocent and he has not committed any offence and prays for anticipatory bail in favour of the petitioner. The learned counsel further submitted that co-accused in this case have already been released on interim anticipatory bail by this Court in Crl.O.P.No.15676 of 2015 and the same was made absolute on 02.07.2015. 4.Heard the learned Government Advocate (Crl.Side) appearing for the State.

5.Considering the facts and circumstances of the case and also considering the fact that the injured person had already been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court No.I, Thoothukudi, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. 6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
