Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. The petitioners, who arrayed as A1 to A4 apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323 and 506(i) of IPC in Crime No.343 of 2015 and hence, seek anticipatory bail.
2.The case of the prosecution is that there is a temple dispute between the defacto complainant and petitioners and in this regard the petitioners have threatened the defacto complainant with dire consequences and scolded him and pushed him out of the temple when the defacto complainant tried to enter into the temple. 3.The learned counsel for the Petitioners submitted that due to temple dispute there is quarrel between them and further submitted that they have been falsely implicated in this case and prays for the relief of anticipatory bail.
4.The learned Government Advoate(Crl.Side) submitted that due to temple dispute the alleged occurrence took place and the injured sustained only simple injury in the said occurrence. 5.Considering the facts and circumstances of the case and considering the fact that the injured sustained only simple injury, I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate,Melur, Madurai District and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction https://hcservices.ecourts.gov.in/hcservices/
to the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6.
