RESPONDENT/RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to extend the time granted by this Honourable court in Crl.OP(MD) No.20565 of 2016 dated 26.10.
2016 for the purpose of surrender before the learned Trial Judge (Special Judge under TNPID Act), Madurai within a period of two weeks from the date of the receipt of the copy of the order and file an application for recalling the non - bailable warrant which shall be considered by the learned Trial Judge on the same day Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.K.GUHAN, Advocate for the petitioner and of MR.P.KANDASAMY, Government Advocate (Crl.side) on behalf of the Respondent the court made the following order:- This petition has been filed to extend the time granted by this Court in Crl.O.P.(MD)No.20565 of 2016, dated 26.10.2016, to file an application for recalling the non-bailable warrant.
2. The learned counsel for the petitioner would submit that the petitioner has failed to surrender before the trial Judge, within the time stipulated by this Court, since the copy of the order was https://hcservices.ecourts.gov.in/hcservices/
received by the earlier counsel for the petitioner is only on 10.11.2016, but the order passed by this Court expires on 12.11.2016.
3. Considering the above facts and circumstances of the case and also the reasons stated in the affidavit filed in support of the petition, this petition is ordered and the time for filing an application for recalling the non-bailable warrant is extended, till 21.12.2016, which shall be considered by the learned trial Judge, on merits, on the same.
