ORDER

This writ petition has been filed to quash the impugned order dated 28.01.2025 and to direct the second respondent to grant permission and protection for conducting Happy Street Festival on 02.02.2025 from 07.00 am., to 11.00 am., at the street from Old Bus Stand to Bunglowmedu, Madurai Road, Theni.

2.The petitioner is running a driving school for woman and he is a social activities. He conducted number of awareness programmes for general public. He started organization in the name of 7 wonders Even Management and the same is duly registered under Ministry of Micro, Small and Medium Enterprises. The petitioner planned to conduct Happy Street Festival and decided to setup stage on the road for the people to display their talents. The event was planned to be held on 02.02.2025 from 07.00 am., to 11.00 am., at the street from Old Bus Stand to Bunglowmedu, Madurai Road, Theni. The petitioner submitted a representation to get permission to conduct Happy Street. However, the 2/5

same has been rejected by way of impugned order. The reasons for rejection is that the place selected by the petitioner is the main road, in which the road connecting Madurai road and various places and further, Railway over bridge is being constructed and hence, already there has been traffic congestion. Further, it is narrow road and hence, there will be a lot of inconvenience to the public and the vehicle movement and therefore, the petitioner was directed to give an alternative place, which was not submitted. Therefore, the petitioner's request was rejected. 3.The learned Senior counsel appearing for the petitioner would submit that he will submit a fresh representation by giving alternative place today itself and this Court may direct the authorities to take a decision, without further delay, since the event is scheduled to be held on 02.02.2025.

4.The learned Additional Public Prosecutor appearing for the respondents would submit that the petitioner can very well give an alternative place, which should not be a main road and other places affecting the general public and movements of vehicles and appropriate decision would be taken.

5.Recording the same, the petitioner is directed to give a fresh representation to the second respondent by giving an alternative place to conduct Happy Street on 02.02.2025. On such representation, the second respondent is directed to consider the same and pass orders, in accordance with law. Accordingly, this writ petition is disposed of. No costs.
