Heard Mr. S.Srikanth, Learned Counsel for the Petitioner and Mr. S.Sabari Bala, learned Counsel for the First, Second, Fourth and Fifth Respondents and perused the materials placed on record, apart from the pleading of the parties.

This Civil Revision Petition under Article 227 of the Constitution of India has been filed to expedite the disposal in O.S. No. 2 of 2021 on the file of the V Additional District Judge, Madurai (hereinafter referred to as 'the Trial Court' for short).

This Court, during earlier hearing on 18.04.2024, had passed the following order:- "2.

The V-Additional District Judge, Madurai shall 2/6

send a report as to whether there is any impediment for conducting further proceedings in O.S. No. 2 of 2021 and if so, explain the reasons for the same, before the next hearing."

In furtherance to the said order, the Trial Court has sent a report dated 05.06.2024, which reads as follows:- "I humbly submit that OS No. 02/2021 on the file of this court has been filed by the Plaintiff in the year 2021 against 6 defendants, seeking the reliefs of declaration and injunction. The said suit is not ripe for trial. Pending suit 4th defendant of this case died and the plaintiff filed IA No.679/2021 to implead the legal heirs of the deceased defendant no.4 which is pending for serving notice to the proposed parties.

I further submit that 1542 cases are pending before this court which includes 576 Original suits and 308 Sessions cases. Out of those cases 336 cases are more 3/6

than 5 years old cases which includes 141 original suits and 110 Sessions cases.

I further humbly submit that I took charge as V Additional District Judge, Madurai on 03.06.2024 only. The Bench Clerk of this court informed that more than 10 High Court direction cases are pending before this court. As per the circular of the Hon'ble High Court, I am giving preference to the Old cases and the direction cases. Under such circumstances, at this stage it is very difficult to proceed with the trial of OS No. 02/2021."

In view of the above report, the learned V Additional District Judge, Madurai, is directed to dispose of the suit in O.S. No.2 of 2021, as expeditiously as possible.

In the result, the Civil Revision Petition is disposed on the aforesaid terms. No costs.
