The present writ petition has been filed seeking a mandamus directing the first respondent to re-issue a passport to the petitioner based on the petitioner's application dated 02.01.2026

The learned Government Advocate (Criminal Side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Crime No.85 of 2013 on the file of second respondent police. The learned Government Advocate submitted that the charge sheet was laid on 26.11.2014 before the learned Judicial Magistrate Court No.VI, Tiruchirappalli, and the same was returned. It was subsequently re-presented on 03.02.2026 and, as on date, it has not yet been taken on file. The learned Government Advocate further brought to the notice of this Court that the petitioner was also implicated in another criminal case in Crime No.258 of 2017 on the file of the second respondent police, which culminated in the filing of a charge sheet in S.T.C. No.2100 of 2017 before the learned Judicial Magistrate Court No.VI, Tiruchirappalli. In the said case, 2/5

the petitioner was convicted and sentenced to pay a fine. The petitioner has paid the fine in the year 2017 itself.

3. In view of the above facts, it is clear that, as on date, no cognizance has been taken so far in Crime No.85 of 2013. Therefore, this Court is of the considered opinion that there is no legal impediment for the first respondent to consider the petitioner's request for issuance of passport. Accordingly, the first respondent is directed to consider the petitioner's application and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.

4. With the above direction, this writ petition stands disposed of. No costs.
