O R D E R

When the matter was taken up, it was brought to the notice that already a petition filed against the 1st accused in Crl.O.P(MD)No.4525 of 2008 was dismissed as withdrawn. The learned counsel for the petitioners seeks permission of this Court to withdraw this petition and he has made an endorsement to withdraw this petition.

2. At this juncture, the learned counsel would submit that the 2nd accused Parasakthi w/o Meenakshisundaram and the 4th accused Meenakshisundaram s/o A.V.Arumugam are senior citizens and therefore, he seeks indulgence of this Court to dispense their presence.

3. Considering the submissions made by the learned counsel for the petitioners, the presence of the 2nd accused Parasakthi w/o Meenakshisundaram and the 4th accused Meenakshisundaram s/o A.V.Arumugam are dispensed with before the trial court except when their presence is specifically directed by the trial court during the service of copy, for questioning under Section 313 CR.P.C and pronouncement of judgment. 2/4
