PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India to set aside the fair and decreetal order dated 28.10.2024 made in I.A.No.3 of 2024 in H.M.O.P.No.815 of 2022 on the file of the Family Court, Kanyakumari District at Nagercoil, by allowing this civil revision petition. ORDER
This Civil Revision Petition has been filed to set aside the fair and decreetal order dated 28.10.2024 made in I.A.No.3 of 2024 in H.M.O.P.No.815 of 2022 on the file of the Family Court, Kanyakumari District at Nagercoil. 1/4
2. The petitioner is the wife and the respondent is the husband and their marriage was solemnized on 02.12.2018. Due to matrimonial discard, the respondent filed a petition for divorce in HMOP No.815 of 2022 before the learned Family Judge, Kanyakumari District at Nagercoil. Pending petition, the petitioner herein filed an interlocutory application in I.A.No.3 of 2024 before the trial Court and the trial Court dismissed the said petition on 28.10.2024.

The learned counsel appearing for the petitioner would submit that the petitioner is depending on her parents The petitioner has filed the above said interlocutory application seeking litigation expenses of Rs.50,000/- from the respondent. However, the same was dismissed. Aggrieved over the same, the present petition has been filed. He would further submit that this Court may fix reasonable litigation expenses to the petitioner.
4. The learned counsel appearing for the respondent would submit that the petitioner is able to maintain herself. He would further submit that the respondent is ready to pay a sum of Rs.5,000/- as litigation expenses to the petitioner.
5. In view of the above, the respondent is directed to pay a sum of Rs.5,000/- (Rupees Five Thousand only) to the petitioner for litigation expenses.

6. Accordingly, the Civil Revision Petition stands disposed of. No costs.
