PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, to direct the respondents to remove the electric pole erected by the respondents 3 and 4 in the petitioner's property comprised in Survey No.202/5 to an extent of 18.5 cents situated at Usilampatti Town and Taluk, Madurai District, based on the proceedings of the 4th respondent in Ka.No.Vu.Mi.Po/Na/Usilai/Va.Aa/Ko.Pudur/A.No. 273/24, dated 21.12.2024.

ORDER

This Writ Petition is filed, seeking issuance of writ of mandamus, to direct the respondents to remove the electric pole erected by the respondents 3 and 4 in the petitioner's property comprised in Survey No. 202/5 to an extent of 18.5 cents situated at Usilampatti Town and Taluk,

2. The grievance of the petitioner is that the respondents erected an electric pole in his property, which is causing much disturbance to him. In this regard, the petitioner submitted a representation, dated 12.08.2024, to the respondents to remove the said electric pole. However, no action has been taken by the respondents. Hence, this Writ Petition.

3. In view of the above facts and circumstances of the case, coupled with the fact that the representation submitted by the petitioner has been pending with the respondents for about six months, the fourth respondent is directed to consider the representation of the petitioner, dated 12.08.2024, and pass appropriate orders on merit and in accordance with law, within a period of two months from the date of receipt of copy of this order.

4. Writ Petition is disposed of accordingly. No costs. 27.02.2025 NCC :
