(CR.NO.89/2013) ... RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the conditions imposed in Crl.M.P.No.10440 of 2016 in Crl.OP(MD)No.14701 of 2016 dated 01.11.2016.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.T.A.EBENEZER, Advocate for the petitioner and Government Advocate (Crl.side)on behalf of the Respondent, the court made the following order:- This matter is listed today under the caption, "for being mentioned', at the instance of the learned counsel appearing for the petitioner.
2. The learned counsel appearing for the petitioner states that this Court, as per the order dated 12.01.2017, directs the petitioner to appear before the respondent Police weekly once ie., on every Monday at 10.00 a.m., until further orders. He has pointed out that in the earlier modification order dated 01.11.2016, this Court directed the petitioner to appear before the Police once in fortnight ie., 1st and 16th of every month at 10.00 a.m., until further orders. Now he wants to modify the condition monthly once.
3. The learned Government Advocate (crl.side) appearing for the respondent states that the present charges under Section 302 IPC., inclusively and the investigation is still pending. https://hcservices.ecourts.gov.in/hcservices/
4. Considering the nature of the offence and stage of the investigation, as stated by the learned Government Advocate, this Court is not inclined to modify the condition imposed on 12.01.2017, as per the request of the petitioner herein. Hence, the request of the petitioner is rejected.
