3.The learned counsel appearing for the respondent has seriously objected to allow this petition. He sought time to file a counter for the past three adjournments and at his request, the matter is adjourned. Today also he has not filed.

4.Therefore, for the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is allowed and the delay is condoned.
