Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the 1st respondent to direct the 3rd respondent not to harass the petitioner and his family members, under the guise of enquiry.

O R D E R

This Criminal Original Petition has been filed seeking direction to the third respondent to not to harass the petitioner.

2. The grievance of the petitioner is that one of his brother, one Raman is said to have been involved in a criminal case and in order to secure the said Raman, the third respondent police is harassing the petitioner under the guise of enquiry. Hence, the present Criminal Original Petition has been filed.

3. The learned counsel for the petitioner would submit that the petitioner was working as a Carpenter and residing in Ponnamaravathy, Pudukkottai District and the said Raman was separated from the family and his whereabouts are not known. He would further submit that Raman said to have been involved in a murder case and in order to secure Raman, the third respondent police is harassing the petitioner.

4. The learned Government Advocate (Criminal Side) would submit that Raman who is the brother of the petitioner suspected to be involved in a murder case and in order to find out the whereabouts of the said Raman, the petitioner was enquired and not harassed by the third respondent.

5. Considering the facts and circumstances of the case, the third respondent police is directed to conduct the enquiry to apprehend the suspected accused and not to harass the petitioner during the course of enquiry.

6. With the above observation, this Criminal Original Petition stands closed.
