This writ petition is filed to direct the respondents 1 to 4 to initiate appropriate action against the fifth respondent, who has committed certain illegalities in his official capacity as Sub Registrar.

The learned Additional Government Pleader appearing for the respondents 1 to 4, on instructions, made a submission that with reference to the complaint submitted by the petitioner, a charge memo has been issued as against the fifth respondent and enquiry proceedings are in progress. In respect of other allegation of corruption, the petitioner is placed under suspension.
3. This being the factum, the respondents 1 to 4 are directed to continue the departmental disciplinary proceedings initiated against the fifth respondent in all respects and conclude the same as expeditiously as possible by following the procedures as contemplated under the Discipline and Appeal Rules. Even during the pendency of the criminal case, the Department is empowered to continue the departmental disciplinary proceedings even by collecting documents and witnesses. In other words, simultaneous proceedings is permissible and there is no bar for the same.
4. With these directions, the writ petition is disposed of. No costs.
