Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of mandamus directing the respondents 1 to 4 to consider the petitioner representation dated 18.06.2018 and to take appropriate legal action as against the 5th respondent herein based on the order passed by the 4th respondent in his proceedings in Na.Ka.No.2185/A4/2017 dated on 07.05.2018 within a stipulated time fixed by this Court.

O R D E R

This writ petition is filed to direct the respondents 1 to 4 to initiate appropriate action against the fifth respondent, who has committed certain illegalities in his official capacity as Sub Registrar.

2. The learned Additional Government Pleader appearing for the respondents 1 to 4, on instructions, made a submission that with reference to the complaint submitted by the petitioner, a charge memo has been issued as against the fifth respondent and enquiry proceedings are in progress. In respect of other allegation of corruption, the petitioner is placed under suspension.

3. This being the factum, the respondents 1 to 4 are directed to continue the departmental disciplinary proceedings initiated against the fifth respondent in all respects and conclude the same as expeditiously as possible by following the procedures as contemplated under the Discipline and Appeal Rules. Even during the pendency of the criminal case, the Department is empowered to continue the departmental disciplinary proceedings even by collecting documents and witnesses. In other words, simultaneous proceedings is permissible and there is no bar for the same.

4. With these directions, the writ petition is disposed of. No costs.
