O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the official respondents to measure and demarcate the petitioner's land comprised in Survey No.49/10A, measuring an extent of 395.25 sq. ft. and Survey No.49/11C, measuring an extent of 411.72 sq. ft., totally admeasuring 806.97 sq.ft., bearing Patta No.41, situated at Page No. 2 of 6
Agaram Village, Eral Taluk, Thoothukudi District, based on the petitioner's application dated 22.07.2025 and the representation dated 12.12.2025.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that an online application has been submitted for the survey of the property in question and for demarcation of its boundaries and a representation has also been made.
4. The learned Additional Government Pleader appearing for the first to fourth respondents would submit that after consideration of the claims of the parties, proper steps would be taken to survey and demarcate the land in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.
5. Recording the aforesaid submissions, this Court directs the second to fourth respondents to consider the online application of the Page No. 3 of 6
petitioner dated 22.07.2025 and also his representation dated 12.12.2025, survey and demarcate the petitioner's land after consideration of the claims of all parties including the private respondents and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners, the private respondents and other interested parties, if any and that if required, police assistance may be taken.
6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
