ORDER
This petition is filed to relax the condition imposed by the learned Principal District and Sessions Judge, Karur, vide order dated 10.01.2024 passed in Crl.M.P.No.47 of 2024 in Crl.M.P.No.2265 of 2022 in C.A.No.152 of 2022 on its file.
2. The case of the petitioner is that he got suspension of sentence till the disposal of the criminal appeal in C.A.No.152 of 2022 pending on the file of the trial Court and he has been complying with the conditions without fail as per the order passed in Crl.M.P.No.2265 of 2022 in C.A.No.152 of 2022 dated 19.12.2022. Since the petitioner is the only breadwinner of his family, he finds it difficult to comply with the conditions regularly. Hence, he filed a petition for relaxing the condition imposed in Crl.M.P.No.2265 of 2022 in C.A.No.152 of 2022 2/6
dated 19.12.2022 before the learned Principal District and Sessions Judge, Karur. Since the appeal is pending and posted for hearing on 30.01.2024, the said petition filed for relaxing the condition was dismissed vide order dated 10.01.2024. Hence, this petition.
3. The learned counsel for the petitioner would submit that it would suffice if a direction is issued to the trial Court to dispose of the appeal within a stipulated time prescribed by this Court.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is regularly complying the conditions.
5. In view of the above submission, without interfering the impugned order, this Court is inclined to direct the trial Court to dispose of the appeal. Accordingly, the learned Principal District and Sessions Judge, Karur, is directed to dispose of the appeal in C.A.No. 152 of 2022 pending on his file, within a period of three months from 3/6
the date of receipt of a copy of this order.
6. With the above direction, this Criminal Revision Petition stands dismissed. No costs.
