Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records relating to the Impugned Public Auction notice passed by the fourth respondent dated 25.01.2022 Quash the same and consequently, direct the respondents not to interfere with the fishery right of the petitioner in respect of Melpurakulam tank in Rajamadam Village.

Heard the learned counsel on either side.

2. The petitioner questions the impugned auction notice issued by the fourth respondent. It appears that the petitioner had entered into a transaction with Thanjavur Parvatha Rajakula Ulnattu Meenavar Co-operative Society and invested substantial sum of money in fishing lease in the petition mentioned waterbody.

3. The case of the petitioner is that if the impugned auction process is allowed to go on, he would lose substantially. In response to the said submission, the learned Government Advocate points out that the petitioner was 2/4

never granted licence by any Governmental authority. If the petitioner has entered into private understanding with some private body, the same cannot bind the fourth respondent. I am not inclined to grant any relief.

4. This writ petition is dismissed. Consequently, connected miscellaneous petitions are closed. No costs.
