PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the first respondent to dispose off the I.A.No.nil/2025 in O.A.No.4/2021 within a time frame. For Petitioner :

ORDER

This Writ Petition is filed, seeking issuance of writ of mandamus, directing the first respondent to dispose off the unnumbered I.A. in I.A.No.nil/2025 in O.A.No.4/2021 within a time frame.

2. The case of the petitioner is that he filed an original application vide O.A.No.4 of 2021 before the first respondent, against the encroachment of land by the respondents therein and pending disposal of the said Original Application, the petitioner also filed an interlocutory application, which is unnumbered, seeking injunction. According to the petitioner, the said application is neither numbered nor disposed of and taking advantage of the same, the respondents therein are carrying out illegal activities in the land. Hence, this Writ Petition.

3. In view of the limited scope of the prayer and also the fact that the interlocutory application filed by the petitioner is pending with the first respondent unnumbered, the first respondent is directed to number the Interlocutory Application in I.A.No.nil/2025 in O.A.No.4 of 2021, if it is otherwise in order and dispose of the same on merit and in accordance with law, within a period of two months from the date of receipt of copy of this order.

4. Writ Petition is disposed of accordingly. No costs. 24.02.2025 NCC :
