ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 6(4) of TNSC (RDCS) Order 1982, r/w 7(1)(a)(ii) of EC Act 1955, in Crime No.388 of 2014 on the file of the respondent police, seeks anticipatory bail.

2. The learned counsel for the petitioner would submit that even though the petitioner has already been enlarged on bail by this Court in Crl.O.P.(MD)No.17789 of 2014, dated 05.09.2015, due to his ill-health, he was not able to surrender before the Court for executing the sureties and hence, he prays for enlargement on anticipatory bail.

3. Heard the learned Government Advocate (Crl.side) appearing for the respondent state.

4. Considering the facts and circumstances of this case and also considering the fact that even though the petitioner has already been enlarged on bail, due to his ill-health, he was not able to surrender before the Court for executing the sureties, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

5. Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate No.I, Virudhunagar and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall report before the Court concerned daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 04/11/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
