ORDER : The Court Made the following order :- The petitioner/accused No.1, who was arrested and remanded to judicial custody on 03.09.2015 for the alleged offences punishable under Sections 302, of I.P.C, in Crime No.1 of 2015 on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that the wife of the defacto complainant's brother died on 03.09.2013 in a suspicious circumstances. For that, originally a case was registered for the offences under Sections 294(b), 323, 397 and 364 of I.P.C and thereafter, the case was transferred to CBCID and the case was altered into under Sections 302 and 392 of I.P.C and on investigation, the petitioner and two others were arrested.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case on the basis of the confession given by one Sivakumar.
4. The learned Government Advocate(Crl. Side) filed a counter affidavit and submitted that on the petition filed by the husband of the deceased, the investigation was transferred to CBCID and charges were altered into under Sections 302, 392 of I.P.C. On the basis of the confession given by one Sivakumar, the involvement of the https://hcservices.ecourts.gov.in/hcservices/
petitioner and others were found out and the petitioner was arrested and remanded to judicial custody on 03.09.2015. He further submitted that the accused murdered the deceased for gain and the investigation is in crucial stage and if the petitioner is released on bail, he will tamper the witnesses.
5. Considering the gravity of offence, I am not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
