This writ petition has been filed seeking a direction to the first respondent to consider the petitioner's representation dated 08.01.2025 and release the lock and seal of the petitioner's shop situated at Melapalayam, Palayamkottai Taluk, Tirunelveli District and permit him to entering his premises within stipulated period that may be stipulated by this Court.
2. It is the case of the petitioner that he had rented out the premises to one Mohammed Ali Hasan, the second respondent herein, who was a member of a banned organization. The Union of India had passed an order banning the organization and directed the concerned State Government to take appropriate action. Pursuant to the order of the Central Government, the premise belonging to the petitioner was sealed on 01.10.2022. The petitioner pleads that he is not a member of the banned association and states that he has the right to use this property, 2/5
which has been closed, due to sealing for more than two years. Hence, the petitioner has filed this Writ Petition.
3. The learned Government Advocate appearing for respondent Nos.1 and 3 would submit that the representation of the petitioner dated 08.01.2025 would be considered in accordance with law.
4. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the first respondent to consider the representation of the petitioner dated 08.01.2025 and pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
