ORDER : The Court Made the following order :- The petitioner, who is the sole accused in Crime No.887 of 2015 for the offences punishable under Section 174 Cr.P.C.@ 302 IPC on the file of the respondent Police, was arrested and remanded to judicial custody on 20.08.2015. He seeks bail.

2.The case of the prosecution is that the husband of the deceased is working in Saudi Arabia and taking advantage of the situation, the accused had developed illicit intimacy with her and on 01.08.2015 due to a sudden quarrel between them, the accused strangulated her and caused death.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case only on suspicion. It is further submitted that the petitioner is in custody for more than 60 days and hence, the bail application of the petitioner may be considered sympathetically. 4.The learned Government Advocate (Crl.side) appearing for the respondent Police vehemently opposed the bail petition. It is further submitted that the accused is an electrician and if he is released on bail, he will go abroad and then he will not be available https://hcservices.ecourts.gov.in/hcservices/ for trial.

5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai, and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. Further, the petitioner is directed to surrender his passport before the Judicial Magistrate No.I, Madurai.
