ORDER : The Court Made the following order :- The petitioners, who are A2 and A3 in Crime No.140 of 2015 for the offences punishable under Sections 302 and 201 IPC on the file of the respondent Police, were arrested and remanded to judicial custody on 25.08.2015. They seek bail.

2.The case of the prosecution is that the deceased had developed illicit intimacy with the wife of the 1st accused and the same was objected by him. It is the further case of the prosecution that the deceased is a financier and the 1st accused had borrowed Rs.1 lkah from the deceased, but, failed to repay the amount. Due to the motive, the 1st accused along with his friends viz.,A2 to A4 had kidnapped the deceased on 10.08.2015 and attacked him with iron road and caused his death. 3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case only on the ground that they are the friends of the 1st accused. It is further submitted that all the accused were secured and remanded to judicial custody.

4.Heard the learned Government Advocate (Crl.side) appearing for the respondent Police.

5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with https://hcservices.ecourts.gov.in/hcservices/

two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate cum District Munsif Court, Vilathikulam, Thoothukudi District, and on further condition that the petitioners shall stay at Dindigul and report before the Town Police Station, Dindigul, daily twice at 10.00 am and 5.30 pm until further orders. sd/- 30/10/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
