ORDER

The writ petition challenges only an enquiry notice issued to the petitioner proposing to hold an enquiry based on the representation given by the second respondent.

2.The petitioner has approached this Court challenging the said enquiry notice, I do not find any justifiable grounds to exercise the extraordinary jurisdiction available under Article 226 of the Constitution of India. It is always open to the petitioner to appear for the enquiry and participate in the proceedings and furnish all relevant documents to substantiate his claim. Without doing so, the petitioner has filed the instant writ petition to quash the enquiry notice, which is not warranted in the facts of the present case. 3.In view of the above, this Writ Petition is dismissed. It shall be open to the petitioner to participate in the enquiry to be conducted by the first respondent, who shall give advance notice of the date of enquiry to the parties, including the petitioner and after hearing the parties, final orders shall

be passed in accordance with law and on merits of the contentions put forth by the respective parties. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. No costs.
