ORDER

This Criminal Original Petition has been filed seeking a direction to set aside the order passed by the Principal District and Sessions Court, Madurai in Crl.M.P. No.603 of 2022 dated 04.02.2022.

2. The petitioners are arrayed as A1 and A2. The respondent police registered First Information Report in Crime No.883 of 2021 for the offences under Sections 294(b), 342,323 and 506(i) of IPC.

3. After registration of the First Information Report the petitioners approached the learned Principal Sessions Judge, Madurai for anticipatory bail in Crl.M.P.No.6168 of 2021. The Court below considered the application for anticipatory bail by an order dated 03.12.2021 and granted anticipatory bail to the petitioners with a condition to report before the respondent police daily at 10.00 am., and 5.00 pm., for a period of 15 days. Thereafter due to illness the petitioners were unable to comply with the conditions and filed a petition for relaxation of the said condition in Crl.M.P. No.603 of 2022 and the said petition was dismissed for the reason that the petitioners have not complied with the condition for a single day. The respondent police have also filed a petition for cancellation of anticipatory bail and the same is pending. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. The learned counsel for the petitioners would submit that now the petitioners are ready and willing to appear before the respondent police without fail.

5. In view of the same, the order passed by the learned Principal District and Sessions Judge, Madurai in Crl.M.P.No.6168 of 2021 dated 03.12.2021 is set aside and the petitioners are directed to report before the respondent police daily at 10.30a.m., for a period of 30 days without fail. If the petitioners fail to comply with the conditions imposed by this Court, the second respondent is directed to proceed with the cancellation of the anticipatory bail petition pending before the Court below in the manner known to law.
