ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the fifth respondent to inspect the lands comprised in Survey Nos.263/1, 263/4A, 264, 265/2A and 265/2B, situated at Kapiliyapatti Village, Oddanchatram Taluk, Dindigul District and consequently, to rectify the erroneous sub-division and FMB entries and issue patta in favour of the petitioner by considering his representation dated 03.05.2025.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that the petitioner is the lawful owner and in possession of the subject properties. However, due to erroneous sub-division entries and incorrect FMB sketches, the subject properties were wrongly shown as forming part of State Highway-37, despite the fact that the road has been laid elsewhere. Hence, the petitioner submitted a representation dated 03.05.2025 requesting to rectify the mistake in the revenue records, but no action has been taken by the respondents. Hence, the petitioner has been constrained to approach this Court by way of filing the present Writ Petition.
4. The learned Special Government Pleader appearing for the respondents submits that the petitioner's representation dated 03.05.2025 will be considered and appropriate orders will be passed on merits and in accordance with law.
5. Recording the aforesaid submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 4 and 5 to consider the petitioner's representation dated 03.05.2025, and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The respondents 4 and 5 are directed to provide reasonable opportunity during such enquiry to the petitioner, and any other persons, who may be affected by such decision. Needless to state that in the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
