ORDER : The Court Made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 03.10.2015 for the alleged offences punishable under Sections 376(1) IPC and Sections 3 and 4 of Protection of Child from Sexual Harassment Act, 2012 in Crime No.6 of 2015 on the file of the respondent police and hence, seeks bail. 2.The case of the petitioner is that both the petitioner and the defacto complainant are lovers and on seeing them, together her parents forced her to give complaint and after filing of the complaint, the matter was compromised. The defacto complainant is studying +2 and after attaining majority, it was agreed that the marriage between the petitioner and the defacto complainant will be arranged.

3.The respondent has filed counter stating that the defacto complainant is a minor girl and she went to neighbour house and at that time, the petitioner forcibly restrained her and committed rape on her. The petitioner is a highly influential person in that locality and if he is enlarged on bail, he will tamper the witnesses and hamper the evidence.

5.Considering the facts and circumstances of the case and also considering the gravity of the offence, this Criminal Original Petition is dismissed.
