Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to call for the records and set aside the sentence and conviction imposed by the learned II Additional Special Court for NDPS Act cases, Madurai in C.C.No.15 of 2006 dated 09.01.2017. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.R.KARUNANIDHI, Advocate for the petitioner and of MR.C.MAYILVAHANA RAJENDRAN Additional Public Prosecutor for the Respondent the court made the following order:- Both the counsel for the petitioner as well as learned Additional Public Prosecutor appearing on behalf of the respondent are present.

2. The report, dated 25.04.2017 received from the II Additional Special Court for NDPS Act Cases, Madurai, which reveals the fact that the petitioner is complying with the condition regularly from 27.02.2017 to 25.04.2017, as per the condition imposed by this Court in Crl.M.P(MD).No.398 of 2017 in Crl.A.(MD).No.12 of 2017, dated 21.02.2017.

3. Considering the reasons assigned by the petitioner for relaxing the condition imposed by this Court and that the Criminal Appeal is pending, this Court is inclined to modify the condition imposed by this Court that the petitioner shall appear before the concerned Court on the first working day of every English Calender Month at 10.30 am till the disposal of the appeal. sd/- 06/06/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.)
