Prayer: Writ Appeal filed under Clause 15 of Letters Patent to set aside the order dated 10.12.2020 passed in W.P(MD)No.18139 of 2020. For Appellants : Mr.T.Amjad Khan Government Advocate For Respondents : Mr.T.Pooventhera Rajan for R.1 No Appearance for R.2

JUDGMENT

(Judgment of the Court was made by G.R.Swaminathan J.) Heard both sides.

2.The writ petitioner is working as secondary grade teacher. She acquired the additional qualifications, namely, M.A and B.Ed. She sought two incentive increments for having acquired such qualifications. Her request was rejected. Challenging the rejection order, the petitioner filed W.P(MD)No.18139 of 2020. The said writ petition was allowed vide order dated 10.12.2020. Aggrieved by the same, this Writ Appeal has been filed.

3.Some confusion has arisen because, in the orders relied upon by the learned single Judge, there is a reference to the grant of two incentive increments. The learned Government Advocate would point out that the writ petitioner would be entitled to incentive increment only for having acquired B.Ed degree qualification and not for having acquired M.A qualification.

4.The learned counsel appearing for the writ petitioner rightly pointed out that in the writ prayer, the relief sought was only for sanctioning incentive increment for having acquired B.Ed qualification and not for having acquired M.A qualification. We are, therefore, of the view that interference with the order of the learned single Judge is not called for.

5.This Writ Appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
