ORDER : The Court made the following order :- The case was registered against the petitioner for the offences under Sections 406 and 420 IPC in Crime No. 1161 of 2021 on the file of the respondent police.
2. According to the petitioner / A1, he is the acting driver under the defacto complainant and A2 and A3 are friends and A4 is the Broker and they have conspired together and took the car by way of rent without having any original papers and the earlier petition filed by the petitioner before this Court in Crl.O.P(MD). No.20717 of 2021 was dismissed as withdrawn.
3. The petitioner counsel appearing for the petitioner would submit that subsequent to which the co-accused was granted anticipatory bail before the Principal Sessions Judge, Madurai in Crl.M.P.No.6625 of 2021, vide order dated 05.01.2022 by observing that major portion of the investigation right have been over at this time.
4. The learned Government Advocate (Crl. Side) would submit that the property has already been recovered. 5.Considering the facts and circumstances of the case and also considering the fact that the co-accused were already granted anticipatory bail by the Principal Sessions Judge, Madurai in Crl.M.P.No.6625 of 2021, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Madurai, and on further condition that the petitioner shall report before the respondent police at 10.00 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C., scrupulously.
