ORDER : The Court Made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 379 IPC in Crime 1/3
No.41 of 2024, seeks anticipatory bail.
2.The case of the prosecution is that the defacto complainant was engaged in manufacturing the hallow block bricks. On 02.02.2024, at about 02.24 pm., his vehicle bearing Reg.No.TN 65 BX 2882 was stolen by the petitioner. Hence, the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Therefore, he prayed to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent Police would submit that the stolen vehicle is not yet recovered and the petitioner herein is having ten previous cases. Therefore, he vehemently opposed to grant anticipatory bail to the petitioner.
5.Considering the facts and circumstances of the case and considering the fact that stolen vehicle is not yet recovered and the petitioner herein is having ten previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
