PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct respondents 4 and 5 not to convert the pathway situated in S.No.600 at Therkku Venganallur Village, Rajapalayam Taluk, Virudhunagar District into graveyard.

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct respondents 4 and 5 not to convert the pathway situated in S.No.600 at Therkku Venganallur Village, Rajapalayam Taluk, Virudhunagar District into graveyard.

2. The negative prayer as such sought for in the present writ petition cannot be granted. It is the duty of the State to construct required graveyard.

3. Further, the learned Government Pleader, on instructions, would submit that graveyard has already been constructed in the subject property.

4. In view of the fact that graveyard has already been constructed, no further adjudication is required in this Writ Petition and the same stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
