ORDER : The Court Made the following order :- The petitioner, who is arrayed as A 24, apprehends arrest at the hands of the respondent for the alleged offence punishable under Sections 147, 148, 341, 302 and 109 IPC, in Crime No.4 of 2019, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused unlawfully assembled and murdered the defacto complainant's husband viz., Arul Samy. Hence the respondent police registered a case against the petitioner.
3. The learned counsel for the petitioner has submitted that based on the confession of A9, a false case has been foisted against the petitioner and he has nothing to do with the alleged offence, and hence, he prayed anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor has submitted that this petition is third anticipatory bail petition of the petitioner. He further submitted that the investigation is at the preliminary stage and there is no change in facts and circumstances of the case and he opposed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5.Taking into consideration the facts and circumstances of the case and also considering the fact there is no change in facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
