PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the respondent No.1 to 3 for providing adequate police protection to the petitioner and his family members for their life and liberty by considering the petitioners representation dated 24.01.2020 within a stipulated time that may be fixed by this Honourable Court.

ORDER

This petition has been filed seeking direction to direct the respondent No.1 to 3 for providing adequate police protection to the petitioner and his family members for their life and liberty by considering the petitioners representation dated 24.01.2020 within a stipulated time that may be fixed by this Honourable Court.

2. The learned counsel for the petitioner would submit that the petitioner's father has purchased a property on 08.09.1965 and subsequently the property was devolved among the petitioner and his brother and sisters by way of partition on 30.01.2004 through a registered deed of partition. The property is situated at T.S.No.26, Trichy city. He would also submit that earlier one Raja Gopal has filed a Civil Suit in O.S.No.1240 of 2011 before the III Additional District Munsif Court, Tiruchirappalli and the same was dismissed on 17.12.2018 by considering all the petitioner's https://hcservices.ecourts.gov.in/hcservices/

property documents and evidence. While So one Subramani/fourth respondent herein came to the petitioner's property on 22.01.2020 at about 11.00 a.m and threatened the petitioner with dire consequences, thereby the petitioner has given complaint to the second respondent and it was sent by post on 24.01.2020. Since the respondent police has not taken any action, the present petition has been filed.

3. The learned Additional Public Prosecutor would submit that the complaint of the petitioner was taken on file in CSR No.51 of 2020 and summons have been issued to both the parties . He would further submit that based on the outcome of the enquiry, if necessary suitable protection will be given.

4. Recording the same, this Criminal Original Petition is closed.
