PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For anticipatory bail in cr.no. not known of 2019 on the file of the respondent police.
ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 498(A) and 507(i) of IPC, seeks anticipatory bail.
2.Heard both sides.
3.Today when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) has submitted that the petition enquiry is pending in this case.
4.Police cannot keep the complaint at the stage of petition enquiry for long without registering regular case. https://hcservices.ecourts.gov.in/hcservices/ 5.Under such circumstances, Interim Anticipatory Bail is granted to the petitioner for a period of two weeks from today and
the petitioner shall report before the respondent police daily at 10.30 a.m and thereafter as and when required for interrogation. In the meantime the respondent police shall either register a case or drop further action.
6.In the event of arrest, the petitioner is directed to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) without sureties to the satisfaction of the Arresting Officer.
7.If a regular case is registered, this order will become infructuous and the petitioner will have to apply afresh for anticipatory bail.
